Our client, a large network of children's swimming studios, is the holder of a trademark. They enter into commercial concession agreements with users and help individual entrepreneurs start businesses by transferring the rights to use the trademark, know-how, and trade secrets.
One of the individual entrepreneurs, a trademark user, filed a lawsuit against our client, demanding recognition of the commercial concession agreement as invalid and seeking compensation for damages. Our company's lawyers represented the client's interests in arbitration court. We successfully proved to the court that there was no causal relationship between the claimed losses and our client's actions. Additionally, we developed a legal position highlighting the correct application of provisions relevant to license agreements to the commercial concession agreement, pointing out to the court that the plaintiff's arguments did not align with the stated claims and that the plaintiff had chosen the wrong method of protecting their interests.
The court ruled in favor of our client in all three instances.
