Last November, our client approached us seeking representation in a case involving the establishment of an easement on their land for laying power lines and connecting the neighboring organization to the electricity grid. Our client was extremely concerned about this requirement, as the easement would significantly reduce the area of their land and create serious obstacles to its use. Moreover, the plaintiff was a major state corporation acting in the interests of a third-party organization.
We analyzed the case, developed a strategy, and attended the preliminary court hearing, which was also attended by representatives of the plaintiff. We undermined the basis of the plaintiff's claims by pointing out the expiration of the technical conditions on which the plaintiff relied as grounds for establishing limited rights to use the land. Additionally, we demonstrated that the organization in whose favor the state body was acting had long ceased to be the owner of the plot to which the electricity connection was planned.
Before the first main court hearing, the plaintiff voluntarily withdrew their claims, and our client was able to continue their activities as usual.
