Contesting Unjust Enrichment.

A lawsuit for unjust enrichment was filed against our client, a wholesale supplier of tea, coffee, and other food products, by a person who acquired the right to claim a debt under a deed of assignment. Our client supplied the buyer (assignor) with tea and coffee for a total amount of 5,150,000 rubles. However, two years later, the buyer's assignee filed a lawsuit claiming that the supply contract was not signed by the buyer, the goods were not received, and the funds were transferred erroneously. In three instances of the arbitration court, we managed to establish a reliable evidentiary base for the case and convince the courts that the funds were not transferred erroneously, but were transferred for specific invoices in non-round amounts by several payments and that the buyer's behavior indicated a lack of genuine claims under the supply contract.

The situation was complicated by the fact that the supply contract and other documents were signed without personal presence, and there was a significant risk of the signatures not matching the actual officers. We managed to prove to the courts that the behavior of the plaintiff and the buyer was an abuse of rights, and protect the client from having the documents checked for falsification. The courts sided with our client.
