Our client, a major clothing retail chain, was previously involved in a legal dispute with one of its landlords. After the conclusion of the court proceedings, a claim was filed against our client for the recovery of several million rubles in litigation expenses.

Our law firm was tasked with developing a legal position aimed at reducing the excessive amount of litigation expenses.

At the client's behest, our lawyers analyzed all the circumstances of the case, identified contradictions in the plaintiff's position, and based on the studied case law and evidence in the case files, prepared a response to the statement for reimbursement of litigation expenses.

Thanks to a comprehensive approach and a well-considered legal position, L1 lawyers were able to convince the court that the evidence presented by the landlord to justify the reasonableness of the claimed litigation expenses could not be the basis for the judicial decision. This is because it was impossible to reliably establish the scope of the provided services, the actual amount of time spent by the landlord's representative on providing legal services, the identities of the legal service providers, etc. Such circumstances indicate an unreasonably exaggerated nature of the claimed litigation expenses.

Furthermore, considering that the dispute was not characterized by particular legal or factual complexity, the claimed amount of litigation expenses was found to be unjustifiably inflated, and its recovery would not comply with the principle of recovering litigation expenses within reasonable limits.

As a result of the case review, the court reduced the amount of litigation expenses for the payment of the plaintiff's representative's services by more than four times.
