   Inchcape Plc is a multinational automotive distribution, retail and services company headquartered in London, with presence in 32 countries. In Russia, the company operates 21 dealerships and accounts for a major percentage of the national automotive market. 

    For five years, L1 lawyers have been providing legal services to the world leader in the retail automobile trade, the Inchcape group, in connection with the construction of a complex of administrative and technical buildings with a floor space of 35,000 sq. m. The total investments of the company associated with the lease of land and the construction of real estate amounted to more than 2 billion rubles.

   During three years, our lawyers defended Inchcape in arbitration courts of all levels, filed appeals to the Supreme Court of the Russian Federation.

   The company's lawyers successfully proved the illegality of the cancellation by the state authorities of the previously issued permits for the construction of a complex of administrative and technical buildings.

   Handling case No. А40-141380 / 15, our lawyers successfully challenged the Order of the Moscow Committee for Architecture and Construction dated 05.21.2015. No. 1834 on cancellation of the act of permitted use of land plot pertaining to the city territory No. A-6399/11 dated 03.10.2008.

   Handling case А40-141378 / 2015-120-979, lawyers successfully appealed against the order of the Committee for Architecture and Urban Planning of the city of Moscow dated May 21, 2015 No. 102 to cancel the urban planning justification.

   In yet another case, No. А40-128801 / 15-121-1057, L1 lawyers successfully appealed against the decision of the Moscow City Property Department to refuse to provide public services dated April 21, 2015 No. 33-5-8913 / 15- (0) -1.

   As part of case No. A40-75957 / 2015, lawyers successfully appealed against the decision of the Committee for Architecture and Urban Planning of the city of Moscow dated 04.14.2015 No. 001-GPZU-112 / 8- (0) -0-4 to cancel the urban planning plan of the land plot at the address: Moscow, st. 2nd Magistralnaya, 18.

   The positive arbitration experience gained by L1 lawyers made it possible to create a strong negotiating position with the Moscow City Property Department and other competent state authorities, and to amend the land lease agreement.

   As a result, an additional agreement was signed on changing the type of permitted use of the land plot. The signing of this agreement made it possible to legalize the construction of a complex of administrative and technical buildings on the land plot and exclude the possibility of recognizing these objects as unauthorized construction in accordance with Art. 222 of the Civil Code of the Russian Federation.

   At the moment, the company's lawyers provide legal assistance to Inchcape in the state registration of ownership of the constructed properties.

   On September 17,2020, a hearing will take place in the Moscow Arbitration Court on case A40-82744 / 2020 regarding the illegal refusal of the Federal Service for State Registration and Cadastre to register one of the objects of the complex of administrative and technical buildings.
